Inlet Condominium Association

On June 1, 2009 CDG tried and won a case in Daytona Beach, FL against Citizens Property Insurance Company. The Inlet Condominium was damaged by the 2004 hurricanes. The Jury awarded the Condo Association $3.3 million for damages.

Aliki Forum

CDG successfully settled a 2004 hurricane property damage case in the amount of 2 million dollars for the Aliki Forum Condominium Association located in Daytona Beach, Florida.  The Aliki Forum building is a 20 story ocean front building. The settlement was with QBE Insurance Corporation.  The claim was made under an insurance policy and was litigated in Volusia County.

Puerto Bello III

CDG resolved a 2005 hurricane property damage case in the amount of $975,000.00 for the Puerto Bello III Condominium Association located in Miami, Florida.  The settlement was with Empire Indemnity Insurance Company.  The claim was made under an insurance policy and was litigated in Miami-Dade County. CDG successfully argued a motion to compel the insurance company to go to appraisal pursuant to the insurance policy. The case settled after Puerto Bello III received a favorable appraisal award.

 

St. Andrews
The Firm recently delivered proceeds from a 4.8 million dollar appraisal award against Florida Insurance Guaranty Association to St. Andrews Condominium Association located in Wellington Florida.  St. Andrews’ buildings were damaged by Hurricane Wilma.  FIGA acted as the receiver for the assets and obligations of one of the Poe Group of Insurance Companies, which became insolvent in 2006. 
 
Oceans Atrium & Oceans Atrium One 
CDG successfully resolved 2004 hurricane cases for two adjacent 12-story towers in Daytona Beach, Florida in April, 2009.  The claims were made under Citizens Property Insurance Company’s policy and were litigated in Volusia County.  The Firm represents and has represented several of the associations in the Daytona Beach area asserting claims under insurance policies issued by Citizens.  The Firm’s familiarity with Citizens has benefited our clients in their settlements.  The Associations represented in these matters will be able to complete the needed restorations for the benefit of their building.

High Point 4 
CDG recently delivered the proceeds of a 5.2 million dollar appraisal award for losses due to Hurricane Wilma, to the High Point Boulevard Association located in Boynton Beach, Florida.  The award was made against Allstate Insurance Company, which had filed a lawsuit seeking to vacate the appraisal award.  Allstate was unable to obtain relief in that case and recently voluntarily dismissed its petition.  The Firm recently obtained confirmation of the appraisal award as a judgment in the lawsuit, and is continuing to seek supplemental relief from Allstate on behalf of the Association.
